These general terms and conditions of sale apply to all orders and sales transactions on www.nojbrussels.com.

Products
All articles sold on NOJ are created on demand. The photographs of the products are as faithful as possible, however we cannot guarantee a perfect likeness, as each article is produced by hand.
Availability
As every item in the online store is made-to-order, it takes about two weeks between the order and the delivery of the package. For specific requests and bespoke jewelry pieces, the delivery time will depend on the complexity of the request and is estimated to take between 3-4 weeks.
Should it take longer than expected, the buyer will be informed about the delay in a timely manner. If the timeline does not suit the buyer, he/she has three (3) working days to cancel his/her order. The amount already paid will be refunded to him/her within 30 days after confirmation.
If the article is no longer available due to raw material shortage or a discontinued collection, the buyer will have an option to either obtain a refund or exchange for a different article.
Prices
All prices and product information can change at any time. 21% VAT is included in our prices.
Order
Upon successful confirmation of an order, the buyer acknowledges full and complete acceptance of the specific sales conditions displayed on their cart on checkout:
- Product name
- Product price
- Product specification(s)
- Quantity
- Shipping costs
NOJ, in turn, acknowledges receipt of the order by email. This confirmation includes:
- The article(s) bought
- Price in € of the article(s) bought
- Price in € of the shipping costs
Security of Payments
NOJ uses an SSL certificate on our website to ensure that all card purchases made online are secure as possible. This means that the buyer's information is passed through a secure connection, so the buyer's card details cannot be read by external parties.
Non-payments
NOJ reserves the right to cancel or to suspend any order and/or any delivery in the event of non-payment or in the event of an existing commercial dispute with the buyer.
Shipping Costs
The delivery costs are clearly indicated on checkout when the buyer finalizes the order. These costs cannot be challenged by the buyer once he/she has paid for his/her order.
Shipping Arrangements
The article(s) will be sent to the address indicated by the buyer on checkout, unless there is a different instruction indicated by the buyer and for which possible additional costs will be billed to him/her. NOJ bears the risks related to the transport of all products ordered up until their successful delivery to the address specified by the buyer. As from that moment, the buyer bears the risks. Delivery timelines are only given for indicative purposes. If these exceed 30 days starting from the date of order, the sales contract can be cancelled and the buyer will be refunded.
If the buyer were to receive a delivered product/delivered products that is/are defective, damaged, or not corresponding to his/her order, the buyer must refuse the package. In the event that the buyer has reservations during the receipt or refusal of the goods, the buyer must declare these, within 48 hours at most, by email to info@nojbrussels.com. On receipt of the returned product(s), NOJ will proceed, according to the buyer’s choice, to either refund or exchange the product(s).
NOJ cannot be held liable in the event of an error related to the shipping details entered by the customer, which would lead to a delay or make delivery impossible. In this case, the products ordered and the delivery costs cannot be subject to a refund. Note that items for shipment to countries outside of Belgium may be subject to taxes, customs duties, and fees levied by the destination country. The recipient of the shipment is responsible for all these fees. NOJ is also not responsible for delays in delivery due to unforeseen circumstances.
Conformity
The buyer acknowledges that he/she has consulted all the information related to the article before his/her purchase. As the articles are produced by hand, each item is unique and may not look like exact duplicates of the photos displayed on the website. The characteristics of the products can thus vary slightly from one article to another, and these differences cannot be used as a justification for refusing a delivered product.
The photographs illustrating the online catalogue are not contractual and may be changed at any moment. NOJ cannot be held responsible for a photo that does not conform to the jewel and/or an erroneous photograph. NOJ only guarantees that the products delivered correspond to the textual description provided on the website.
Return & Exchange Policy
The buyer has 14 calendar days to return or exchange the article(s). The buyer must either bring the article(s) back in store or send us back the article(s) by post at his/her own cost. You can consult our address, contact details, and opening hours here.
This 14-day period starts as from the date of delivery of the articles and the article(s) must be returned to NOJ in perfect condition and in their original packaging.
Should the buyer wish to return or exchange (an) article(s), the buyer must use our withdrawal form or notify NOJ by mail at info@nojbrussels.com with the following information:
- Order number
- Information about the article(s) you wish to return or exchange
- Reason for return or exchange
Once the return has been received and deemed suitable for resale, we will proceed to either carry out a refund or an exchange. The refund will be carried out by bank transfer within 30 days.
The buyer’s right of withdrawal is suspended in case one of the following events arise in relation to the article(s) returned:
- Damaged article(s) with signs of wear & tear, scratches, or items which have been visibly worn
- Incomplete article(s)
- Article(s) without their original packaging
- Article(s) for which it is difficult or even impossible to sell
In these conditions, the article(s) in question will neither be taken back nor exchanged and the costs of sending it back will be borne by the buyer. Additionally, all made-to-order pieces and bespoke requests are not eligible for a return or exchange.
Intellectual Property
All elements in our website (e.g. literary, graphic, phonographic, photographic and electronic data), as well as the articles displayed, are the property of NOJ and are protected by intellectual property laws. Any act of reproduction or transmission, other than exceptions exhaustively acknowledged by the law, and unless there is an explicit and written agreement from NOJ, is prohibited and subject to civil and criminal penalties.
Guarantees
The invoice or the order confirmation acts as a guarantee and must be kept by the buyer. This guarantee only covers existing defects at the time of the delivery of the goods. Defects or damage caused by poor use (e.g. water damage, oxidisation, falling or shocks, negligence, wear and tear, etc.) are not covered by the guarantee. Similarly, repairs carried out by experts that have not been approved by NOJ will result to the cancellation of the guarantee.
Updates to the Terms & Conditions
It remains the responsibility of the buyer to consult our general terms and conditions of sale online, which take precedence over any other contractual conditions. Any contractual modification to the general terms and conditions of sale can be challenged by the buyer within 72 hours of their being put online.
Claims
Any claim on an online purchase must imperatively be formulated within 48 hours following receipt of the order or it will be legally inadmissible. Any claim must be addressed by mail to info@nojbrussels.com and include the references of the article concerned and the precise reasons for the disagreement.
Liability
The liability of NOJ, whatever the nature of the prejudice, will be, in any event, limited to the amount of the total order. In case of non-execution, the liability of NOJ cannot be sought if the non-execution of the sales contract or its poor execution is attributable either to the buyer or to the unpredictable and insurmountable fact of a third party foreign to the sale or finally to a case of force majeure.
Proof
Computer records or logs processed by NOJ (e.g. proof of orders, electronic communications, payments, etc.) are considered as a valid means of proof between the parties.
Indivisibility
If one of these provisions is invalidated by the application of a law, a regulation, or following a court decision that has become definitive, the parties agree that the other provisions will remain fully applicable.
Disputes
These online conditions of sale are subject to Belgian Law. In the event of a dispute, the courts of Brussels have jurisdiction, subject to binding public order provisions. The buyer is also advised of the existence of the European ODR Platform. This platform aims to assist in settling online disputes with regards to contracts agreed online between a buyer and a seller. They also provide the buyer with measures for settling disputes amicably and the service is provided by entities that are qualified to deal with disputes between consumers and companies or liberal professions located in the European Union.
